Notice to Patients of Federal Confidentiality Requirements under 42 CFR Part 2
Effective: March 20, 2025
42 CFR Part 2 places stringent restrictions on certain records in addition to those provided by HIPAA/HITECH and state/local laws and regulations. This clinic meets the definitions specified in Part 2 and thus the following records are protected:
Records relating to the diagnosis and/or treatment of any substance use disorder
In general, the program may disclose an individual’s status as a patient or disclose/transmit any records pertaining to covered treatment in the following instances:
The patient’s written consent is obtained pursuant to Subpart C. The consent provided on our patient portal meets the requirements of Part 2, but any written consent with all the requisite elements can be submitted.
An authorizing court order is entered pursuant to Subpart E. We are prohibited from complying with a warrant or subpoena unless it is accompanied by a valid court order pursuant to this subsection.
In the event of a medical emergency, as defined in 42 CFR § 2.51
In conductance of scientific research, as defined in 42 CFR § 2.52
For the purposes of an audit or evaluation, as defined in 42 CFR § 2.53
For public health reasons, as defined in 42 CFR § 2.54
Certain records and circumstances fall outside the protections of Part 2. If a patient commits a crime on our premises or against its personnel, information directly related to that specific crime is not protected. In addition, information needed to make a report of suspected child abuse or neglect are not protected.
